Terms of Service
The Tryonic AI Platform Usage Policy sets out the terms and conditions that apply when a User accesses or uses the Tryonic AI Platform or the Services on it. By using the Platform and/or the Services, you agree to comply with all provisions of this Policy and to be bound by it. If you do not agree, please do not use the Platform or any Service on it.
We may update, amend, or change this Policy at any time without prior notice. Continuing to use the Services after a change means you accept the updated terms. Please read these terms carefully, as they form a legally binding Agreement between you and Tryonic AI Co., Ltd. This Policy and all related activities on the Platform are governed by the laws of Vietnam in all cases.
A. General terms
1. Definitions
Unless defined otherwise, capitalized terms in this Policy have the following meanings:
- "Agreement" / "Policy": this Tryonic AI Platform Usage Policy, including all terms, conditions, and notices contained or referenced in it, and the operating rules and procedures we may publish on the Platform from time to time.
- "We" / "Tryonic AI Co., Ltd": the operator of the Platform and provider of the Services — Tryonic AI Co., Ltd — together with all of our contractors, officers, and employees.
- "User" / "You": the party accessing or using the Platform and/or Services, whether an individual, legal entity, or organization.
- "Platform": the Tryonic AI Platform at https://tryonic.ai/en and all Content, Services, and Products we provide through it.
- "Services": the services Tryonic AI provides that allow Users to create Products, designs, and Content using artificial intelligence or from the User's own existing sources.
- "Content": the content accessed or displayed through the Platform (text, data, images, graphics, software, designs, features, and so on) available on the Platform or generated through the Services, as well as content uploaded or otherwise provided by the User.
- "Products": the products we provide through the Platform that Users can create and/or order by using the Services.
2. Access and membership
To use the Platform and Services, you must register an account and become a member; you may cancel your membership at any time on the Platform. To complete registration, you must provide your first name, last name, email address, and password. You may not use another User's account without permission, are fully responsible for activity on your account, and must keep your password confidential and notify us immediately of any security breach. We are not liable for your losses caused by unauthorized use of your account.
We may change, suspend, or terminate use of the Platform and Services, impose limits on certain features, or restrict access without prior notice if fraud or unlawful conduct is detected. If you are an individual, you confirm that you are at least 18 years old and have full civil capacity; if acting on behalf of a legal entity or organization, you confirm you are duly authorized. You agree to take full responsibility for your choice and use of the Platform and Services.
3. Amendments and updates
We have the right, at our sole discretion, to amend, supplement, or update ("Update") this Policy at any time. All updates take effect immediately upon publication on the Platform. Your continued use after we publish them means you accept the amended Content. If you do not agree, you must send us a notice to close your account; we will close it within 30 days of receiving the notice.
4. User responsibilities
We and our authorized parties have the right (but not the obligation) to pre-screen (automatically and/or manually), refuse, remove, block, or disable any Content that does not comply with the law and/or this Policy. You assess and bear all risks related to your use of any Content. Without limiting other remedies, we may restrict, suspend, or terminate the Services and your account, ban access, and remove or disable Content if we believe you are causing problems, creating potential legal liability, or violating this Agreement. Any harassment of or offense toward our staff may result in immediate account termination. You are responsible for providing accurate and truthful information; if inaccurate information causes damage, you are liable.
5. Service fees, taxes, and payment
You may choose to save your payment information for future orders and fees; this information is stored and processed by third-party payment service providers compliant with the PCI DSS standard. You are ultimately responsible for keeping your payment information up to date. When you order a Product or use a paid Service, you agree to pay the fees in effect at the time of ordering; fees for the Product, Service, and related delivery costs are shown on the Platform when you order or pay.
By paying, you confirm you have the legal right to use the payment method provided; if paying by card, you are the cardholder or have the cardholder's permission. We may refuse to process a transaction or to provide the Services at our discretion. You are responsible for paying all applicable fees and taxes (including VAT). The full amount plus taxes and delivery fees must be paid in full before the Product is shipped.
6. Shipping and delivery
After confirming an order, you will not be able to modify or cancel it. If you wish to make changes, please check the options in your account or contact us; we are not obligated to make such changes but will do our best on a case-by-case basis. Risk in the Product passes to you once we complete delivery; ownership transfers from the moment payment and delivery are completed.
We deliver within the territory of Vietnam. Shipping fees are added to the Product price, may vary by location and/or Product type, and additional fees may apply for remote or hard-to-reach locations. Delivery is carried out by carriers; orders may be delivered to parcel lockers or other designated pickup points. We can only provide an estimated delivery date and, to the extent permitted by law, are not liable for delays against the estimate; we will try to contact and inform you of any changes.
7. Product descriptions
We strive to provide the best images and descriptions, but the actual Product specifications (color, detail, size, position, and so on) may not be 100% accurate compared to the images shown on the Platform. If a Product you ordered is out of stock, we will notify you, and you may choose an equivalent Product or wait for restocking. If a replacement Product costs more, you pay the difference; if it costs less, we refund the difference.
8. Purchasing Products
An order is valid once you have completed payment and we have confirmed it; we may decline any order at our discretion. Before submitting an order, you are responsible for checking and accepting your purchase (quantity, type, design, and so on) and for providing accurate delivery information (recipient name, address, postal code, phone number, email, and so on). We are not liable for failed delivery due to incorrect recipient information.
We may suspend your order if we detect issues with the Content, print file, security, or other matters. In that case we will ask you to resolve it within 30 working days; if you do not resolve it or cancel within 30 days, we will cancel the order and will only refund if we have not yet started printing your order.
9. Intellectual property policy
We respect the intellectual property rights of others and strictly prohibit any use of the Platform or Services to infringe the intellectual property rights of others, including uploading or using AI to create Content, or producing or selling goods that infringe copyright or are counterfeit. By uploading Content or using AI to create Content, you represent and warrant that:
- You own the Content or have the legal right and authority to use it;
- Uploading and using the Content does not violate, misappropriate, or infringe the rights of any third party (privacy, publicity, copyright, trademark, and/or other intellectual property rights);
- You agree to pay all royalties, fees, and other amounts arising from your use of the Content;
- When using AI, you commit not to use prompts or hints (explicit or implied) to create Content that infringes third-party rights or any Prohibited Content.
You are solely responsible for the Content you upload or create. We may refuse to produce Products containing Content we have reason to believe infringes intellectual property rights or contains Prohibited Content, and may temporarily or permanently suspend accounts that receive multiple intellectual property infringement notices.
10. Governing law and dispute resolution
This Agreement and all disputes or claims arising from or related to the use of the Platform and Content are governed solely by the laws of Vietnam. The User agrees to waive any choice-of-law rights regardless of nationality or place of residence. All disputes will be resolved at the Vietnam International Arbitration Centre (VIAC) under its rules of procedure. The number of arbitrators is 3 (three); the seat of arbitration is Hanoi, Vietnam; the language of arbitration is Vietnamese.
B. Terms of use
1. Content requirements
All Content you upload, use, or create ("upload") using the Services is considered your Content; we have no ownership of it. Ownership of Content generated by AI on the Platform belongs to Tryonic AI.
License: By uploading your Content to the Platform, you grant us a non-exclusive, irrevocable, sublicensable license to edit, modify, copy, distribute, store, and create derivative works from your Content in order to provide, improve, and promote the Services and/or Platform in any format and through any channel (including third-party platforms, advertising media, and/or social networks). You confirm you have the right to grant these rights to us.
Reporting infringing Content: If you have grounds and evidence that someone has used your copyright or trademark without authorization, please report it to us as set out in our Intellectual Property Policy.
2. Prohibited content
You commit not to upload, use the Platform to create, or attempt to create Content and/or Products containing the following:
- Elements that negatively affect children under the Law on Children: discrimination; content that affects the healthy development of children; disclosure of a child's private life; causing children to have thoughts or actions contrary to morality and good customs; or inciting children to perform dangerous acts.
- Harassment, bullying, defamation, or threats against a specific individual.
- Hateful content: condoning or promoting violence against others based on race, ethnicity, skin color, nationality, religion, age, gender, sexual orientation, disability, health status, or veteran status; or promoting crime and/or terrorism.
- Content that violates Vietnamese law or violates good customs and social morality.
- Content that infringes intellectual property rights or does not comply with our Intellectual Property Policy.
- Personal and confidential information (credit card numbers, ID/citizen ID numbers, third-party account passwords, and so on) without consent or authorization.
- Self-harm: content promoting self-harm.
- Terrorism support: content implying or promoting support, funding, or participation in a terrorist organization.
- Misinformation that is harmful and may lead to violence or threaten the health and safety of the community.
- Political elements, disputes between countries or territories, or content violating prohibited acts in the field of Vietnamese security and national defense under the Law on National Defense and Security.
⚠️ Note: We may remove Content and/or suspend, restrict, or terminate your use of the Platform at any time without prior notice if the Content violates these Terms of Use, our Intellectual Property Policy, or Vietnamese law. Where a matter exceeds our authority to handle, we may transfer information and records to the competent authorities.
3. Platform and Service usage requirements
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services and Platform, subject to the following restrictions:
- No unlawful use: comply fully with Vietnamese law and relevant international treaties (commerce, tax, competition, and so on). Do not impersonate us or any individual or organization; do not exploit or harm children or minors in any form.
- No harm to the Platform: do not interfere with or disrupt the Services, distribute viruses or malicious code, or engage in conduct that restricts others from using the Services. We may inspect the Platform to ensure its integrity and compliance with this Agreement.
- Brand guidelines: the name "Tryonic AI", the symbols, logos, and designs are trademarks protected under Vietnamese law. Except as set out in this Agreement, we grant you no right to use our trademarks. You may not use our trademarks as your own, in a way that causes confusion or deception, or that harms us; we may require immediate removal of any misused content.
4. Service quality commitment
We strive to provide the Services at the best quality within our ability; however, unintended errors may arise during operation. To the maximum extent permitted by Vietnamese law, we make no warranties, whether express or implied, regarding the Services (including warranties of non-infringement of intellectual property, merchantability, or fitness for a particular purpose). Where Vietnamese law has mandatory warranty provisions, those provisions prevail.
5. Warranty, exchange, and return
Immediately upon receiving the Product, you are responsible for inspecting it. If the Product has a serious defect (including any defect we caused during printing), is damaged on receipt, or is incorrect, please submit a request within the warranty period. We warrant that, at the time of delivery, the Product is free of serious defects or damage; please contact us for warranty within 14 days of receipt. Warranty benefits end if you sell or transfer the Product, unless approved by us.
The warranty does not cover damage or defects caused by:
- Your fault or that of a third party;
- Improper handling during use or storage;
- Failure to follow the usage instructions, resulting in a defect;
- The Product having been repaired, modified, or no longer in its original condition;
- Force majeure (accident, fire, flood, natural disaster, and so on);
- The actual Product achieving 95% or more accuracy compared to the image on the Platform;
- Items supplied by third parties, size exchanges, or the buyer no longer needing the item after purchase.
Warranty period: 14 (fourteen) days from the delivery date. After this period, if you do not respond or respond unclearly about defects, you are deemed to have accepted the Product quality. For Products that are defective or seriously damaged, we will (a) replace them free of charge, or (b) refund the amount you paid plus the corresponding shipping fee. For exchanges or returns not due to a defect, we are not obligated to comply but may consider them case by case — please contact us for support.
C. Data collection — Information security
We respect your privacy and are committed to protecting Users' personal data in accordance with the law on personal data protection. The Platform and Services are not directed at people under 18, especially children (under 16 under the Law on Children). We do not knowingly collect, store, disclose, or sell the Personal Data of minors or children; if we discover we have collected it, we will delete it.
We may collect data directly from you, from others, or by automated means (information you provide directly; tracking technologies such as cookies; from service providers; from third-party platforms and social networks; and from other sources). The types of information may include:
- Identification and contact information: name, postal address, delivery address, email, phone number.
- Payment information: payment details (including the first and last digits of the card).
- Commercial information: services you have purchased or are considering, and your preferences.
- Device and identifier information: IP address, device and browser, referring page, timestamps, cookie details.
- Geolocation data: approximate location based on your IP address.
- Government-issued identity documents (where necessary).
- Content: your communications with us and other Content you provide (social media profiles, images, video, survey responses, comments, reviews, and so on).
We do not collect any "sensitive data" (racial or ethnic origin, political opinions, religious beliefs, genetic data, biometric data, health data, sex life or sexual orientation, and so on). Data is used to: provide and manage the Services; communicate and provide support; analyze, personalize, and develop products; market and advertise (based on consent or legitimate interest); and ensure security, prevent fraud, and comply with the law.
Storage and security: We store personal data for as long as you maintain an account or while a legal basis to process it remains, and may keep copies where needed to comply with legal obligations, resolve disputes, or prevent fraud. We apply reasonable organizational, technical, and administrative measures (access controls, encryption, and anonymization where possible). You should set a strong password, limit access, and log out after each session.
D. Disclaimers and limitation of liability
- Content you access: While using the Platform, you may encounter Content you find offensive or inappropriate. We are not responsible for Content posted by others or generated by AI, nor for its accuracy, legality, or propriety. You agree to release us from any legal liability related to such Content.
- Warranty liability limit: Where a warranty policy applies, the remedies in that policy are your sole and exclusive remedy. Our liability for a defective Product does not exceed the actual value received, and does not include indirect, incidental, or consequential damages.
- Limitation of legal liability: To the maximum extent permitted by Vietnamese law, we are not liable for lost profits or revenue, loss of data or business value, or indirect, incidental, special, or consequential damages. Our total liability (if any) will not exceed the total amount you actually paid for the relevant Services. This does not exclude liabilities that the law does not permit to be excluded (including damage from willful misconduct or consumer-protection obligations).
- AI-generated Content: Content generated by AI may be inaccurate, incomplete, or inadvertently overlap with third-party content. We do not warrant its legality, intellectual-property protectability, or suitability; you are responsible for checking, evaluating, and bearing final responsibility. You agree to release us from any legal obligation, claim, compensation, or cost arising from Content you upload or generate with AI, except as otherwise provided by law.
